The bill (Reg. No. 2724) aims at refining current version of the Law “On the Constitutional Court of Ukraine” in the part of implementing decisions and conclusions of the Constitutional Court.
It is suggested to provide a new version of article 67, under which “decisions and conclusions of the Constitutional Court of Ukraine together with separate thoughts of judges of the Constitutional Court of Ukraine should be published in the official printed editions, or in the “Visnyk Konstytutsiynoho Sudu Ukrainy” during 10 days after they were signed”.
The Committee believes that provisions of the bill are based on the constitutional and legal framework. Thereat, certain remarks were made during its discussion.
Attention was primarily drawn to the facts that “Visnyk Konstytutsiynoho Sudu Ukrainy” is a scientific journal, founded by the Constitutional Court and issued 6 times a year. Thus, the requirement in regard to publishing in this journal decisions and conclusions of the Constitutional Court during 10 days after they were signed is unacceptable.
Apart from this, new version of article 74 contradicts part two of article 147 of the Constitution of Ukraine.
